(hereinafter, “OPENCHIP“) provide to you with updated information on the processing of personal data that OPENCHIP may carry out in the course of your browsing and interaction with the options made available on the website https://openchip.com/ and its subdomains (hereinafter, the “Website“), including through the profiles of Social Network where OPENCHIP has a presence, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter, the “GDPR“), the Spanish Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (hereinafter, the “LOPDGDDD” for its acronym in Spanish) and other local regulations on data protection.

2. WHAT PERSONAL DATA DOES OPENCHIP PROCESS?
From OPENCHIP we collect personal data from users in the following ways:
- When you fill out any of the forms made available on the Website or share personal information with OPENCHIP through the Social Network profiles where it has a presence;

3. FOR WHAT PURPOSE AND ON WHAT LEGITIMATE BASIS DOES OPENCHIP PROCESS YOUR PERSONAL DATA?

Legitimation: The legal basis for such processing is User’s consent, which shall be understood to be granted by the affirmative action that takes place with sending of the form to submit your request, by sending your request by email or through OPENCHIP’s Social Network profiles.
Retention period: Personal data will be kept only for the period of time that is necessary to duly attend to and manage Users’ requests and/or queries, being subsequently blocked for the demand of possible liabilities arising from the processing and only for the period of limitation of the same, after which they will be deleted.
b) Manage and, where appropriate, evaluate job applications submitted by Users, either directly, through the means of communication enabled on the Website (for example, forms enabled to register for a vacancy in OPENCHIP or corporate email address through which they can send spontaneous applications) and / or in collaboration with third parties that manage job offers or job applications OPENCHIP.
Legitimation: The legal basis for such processing is the implementation, at User’s request, of pre-contractual measures linked to the intention to conclude an employment contract with OPENCHIP.
Retention period: Personal data will be kept only for the period of time necessary to manage the User’s candidature and thereafter, if not selected, being subsequently blocked for the demand of possible liabilities arising from the processing and only for the period of limitation of the same, after which they will be deleted.
c) Maintain personal data submitted by Users when making a job application to be considered as a candidate for future employment opportunities at OPENCHIP, when OPENCHIP offers this possibility to the User to freely choose their choice and the latter provides its consent to it.
Legitimation: The legal basis for such processing is the consent that, where appropriate, the User grants to OPENCHIP for the storage of their personal data for this purpose. The User has the right to withdraw consent at any time, without such withdrawal could affect the lawfulness of the processing based on the consent prior to its withdrawal.
Retention period: Personal data will be kept until the withdrawal of User’s consent, being subsequently duly blocked for the demand of possible liabilities arising from the processing and only for the period of prescription of the same, after which they will be deleted.
d) To send the User commercial communications related to OPENCHIP’s products, services and news (for example, in the form of newsletters) through electronic means, provided that the User has given his/her consent to receive this type of commercial communications.
Legitimation: The legal basis for such processing is the User’s consent, which shall be understood to be granted by the affirmative action that takes place with the sending of the form to submit your request to receive the OPENCHIP newsletter when the form only has this purpose or, in other cases, with the acceptance of the corresponding box located on the OPENCHIP forms.
Retention period: Personal data will be retained until the User revokes their consent, if any, given, and may subsequently be retained blocked for the demand of possible liabilities arising from the processing and only for the period of limitation of the same, after which they will be deleted.
e) Maintain contact details, as well as those relating to the function or position, of Users who contact OPENCHIP for professional reasons when, acting as service providers of any kind or collaborators, contact OPENCHIP through the Website (for example, forms or corporate email address) or their Social Network profiles to establish a professional relationship with the legal entity that they represent or, in the case of individual entrepreneurs and liberal professionals, when they contact OPENCHIP solely in that capacity.
Legitimation: The legal basis for such processing is the legitimate interest of OPENCHIP to maintain the necessary data to locate professionally the Users (in particular, service providers of any kind or collaborators) for the sole purpose of maintaining a professional relationship, in accordance with the provisions of Article 19 of the LOPDGDD.
Retention period: Personal data will be retained until the User objects to OPENCHIP to continue retaining their contact details for this purpose, and may subsequently be retained blocked for the demand of possible liabilities arising from the processing and only for the period of limitation of the same, after which they will be deleted.
4. COMMUNICATIONS OF PEROSNAL DATA
Users’ personal data will not be transferred to third parties, except in cases where there is a legal obligation to do so in compliance with the applicable regulations.
Also, Users’ personal data may be accessed by third parties acting on behalf of OPENCHIP, provided that such access and data processing is essential for the provision of a specific service to OPENCHIP.
Under such a scenario, OPENCHIP will, in any case, enter into a data processor agreement with such third parties to process personal data exclusively for the determined purposes by OPENCHIP and according to its instructions.
5. INTERNATIONAL TRANSFERS
For some services, Users’ personal data may be processed, accessed or stored in a country outside the European Union without providing an equivalent level of protection for personal data.
